Date Posted: Tue, Sep 01 2009, 14:51:10 In reply to: John 's message, "Look who's talking" on Tue, Sep 01 2009, 14:18:59 I have a concern about a citizen Patrol authorized \ approved by the HOA board. if the HOA condones\approves of the Patrol, and someone is confronted while patroling and is hurt, is the HOA liable for damages? Is the HOA now responsible? I know that there must be training, and must be limits to roles\responsibility, but seems like a concern for me. I have confronted people in the parking lot, going over with a neighbor\friend of my own free will. If I got hurt, it would be my own fault, however - now that the board has been alerted to dangers (real or perceived) - isn't the HOA already liable and exposed if they do nothing? I can see (being from California - the Sue Me State) a lawsuit coming and wiping out the HOA funds. Just something to consider. As you all can see, this isn't as cut and dry, nor as easy as people think. This is why it's been going on so long. [ Next Thread | Previous Thread | Next Message | Previous Message ] |
