Sydney smart cards stalled by lawsuit

Legal action has been launched against the Department of Transport and the government over its alleged handling of the tender process for the integrated ticketing project (ITP) in Sydney.

Cubic Transportation Systems, a member of the Smartpos consortium, has obtained an injunction preventing the government from signing the contract with preferred tenderers ERG and Motorola, according to NSW Department of Transport spokesman Stuart Snell.

“No contract arrangements will be entered into until the hearing is complete as required by the Supreme Court,” Snell said.

“The Department will vigorously defend against the claims made by Cubic”.

The hearing has been set down for February 18 and 19, but progress in negotiations is being made despite the current legal action, according to ERG ceo Peter Fogarty.

“Both the Department of Transport in NSW and ourselves are continuing to negotiate the contract terms, and we’ve made progress in that regard,” Fogarty said.

“We hope to be in a position to sign shortly, but we’ll just have to await the outcome of the court case [before that can happen]”.

The $100 million Sydney ITP project was awarded to the Integrated Transit Solutions consortium made up of ERG and Motorola in mid-August last year as the result of a protracted tender process.

Under the deal, the winning consortium will provide a contactless smart card system stretching all modes of public transport in Sydney and the surrounding region.

Final terms of the agreement were initially expected to be complete by December 31, but an injunction brought against the Department by Cubic Transportation Systems has delayed that outcome.

When the system is completed in 2005, commuters will only need to pass through a validator in the entry/exit area of the station to have their ‘ticket’ authenticated.
