for any who are interested here is a debate transcript between Christopher Bond R (one of 9 who voted against the McCain amendment in the Senate) and Richard Durbin (D) who was one of 90 who voted for it) from online newshour PBS

I'm not ashamed that we are debating this issue. I'm proud that we are doing it so quickly...I'm proud of patriots like Ian Fishback, who at great risk to his professioanl career continued to seek an audience who would listen to his ethical stand. I'm proud of people like McCain who are involved in the muddled world of politics, who have ambition and who may falter simply by participating in the imperfection of politics... and still, nonetheless is making a statement and accepting the responsibility of Fishback's request....

Its not black and white to me...
