I've been fighting this NOD since I was awarded my claim in 2011. I had a hearing schedule with BVA, but my VSO talked me out of going to the videocom, because he said we would be laughed out of the hearing room. He said the Judge would site the "Nehmer Court Order, the date I filed" I submitted a NOD and that's when the S%*#T hit the fan. My VSO at that time was with the VVA. She called me and read me the ryeit act and said "You guys are all alike, all you are looking for is the money" she said that she wouldn't represent me as of that date. (I wonder if she spent any time in Nam. or just sit behind a desk in the States?)
I then went to the VSO list and called the DAV and told them my story. I didn't disagree with the % of the award, but the date they award me my claim. I have been looking on the web under ( VA using my SSD award date as my VA Award date. )If I get the retro back pay, we're looking At almost 18 yrs (1988-2006) since I went on Retirement Disability and SSD.
Right now I am waiting for a court docket # and a hearing date. I am almost sure I'll be turned down, but then I can hire a Lawyer and go on to the next step (CAVC).
I'm sure that the ROVA is hoping that I just say the H with it and drop my NOD. I say: "Snow ball chance in H###"
When I was working (as a Construction Inspector) I ran into contractors that would try to cut corners, but I had a good PE and the Specks to go buy. Now it not the money (but it sure would be nice) its the principal of the claim. How many other Vietnam Vet's are in the same boat (No pun intended) Back in 1967 and the 70,s, 80's and even the 90's you didn't mention that you fought in Vietnam, (unless you wanted to be shoned, spit on, called a baby killer, and the list goes on and on.
All I'm looking to have the Veterain Affairs to reconize my sacrifice I gave to fight for our country, and then receive the compensation I'm due.
In 1967 when I got out, I didn't hear anything about compen-sation. I had my first MI on May 22, 1981, my first of 3 by-passes in 1984. I was 36 yrs old. when this all started.
In 1990 after 4 claims were denied. Social Security awarded me Disability Compensation, I no longer was able to work (Sound famillar)
I think the VA and SS must have a bet to see how long A Vets has to wait before a decision is made or they give up. Well their barking up the wrong Vietnam Vet, I'm not giving up until I go to Haven because I spent my time in Hell. (And that could be arranged). I'm just looking out for my family. They will get more compensation if I were gone, sorry to say. Till then I'll just keep calling my VSO-DAV.
