The Respondent, ________________ RN. Or “Nurse or “I.” files this Objection to Motion to Assess Costs in Accordance with Section 456.072(04) (“Dept of Health Motion or “Motion”)and moves the Board of Nursing to require the Department of Health’s attorney’s to Provide Documentation in Support of their Motion and as grounds states;

1. Motion states that the investigation has resulted in costs of $__________________ resulting primarily from fees of the Department of Heath’s attorneys or their assistants.
2. The attached time Tracking system makes references to the time spent in such general terms that it is impossible to determine if the work being charged justified the time, more specifically, vague references to Investigative Work, or Supplement Investigation, Telephone calls without any indication of who was called or the subject of the call, and most egregious a category call “Miscellaneous.”
3. The Nurse would therefore request the Board to require the Department of Health to provide all documentation, including but not limited to letters, notes relating to phone calls and investigative reports, the subjective of the investigative work, and any other matters relating to the billing.
4. Any items that the Department of Health deems privileged may be crossed out or omitted HOWEVER, the Department of Health must provide some explanation of what documentation; notes, etc. were deemed to be privileged and the support of the claim of privilege.
5. The Nurse believed that there was a good basis for the original billing, but now believes that there are questions regarding the time expended as well as the nature of the work.
6. However, in order to resolve this issue without further stress or litigation is willing to abide by her counter-offer to settle this action for $2,500.00 payable at the rate of $200.00 per month once the Nurse retains to her employment as a nurse.

WHEREFORE, the Nurse respectfully requests the Board of Nursing to enter an order requiring the Department of Health to provide all documentation, as requested in this Objection, and any other and further relief this court deems just and proper.
