I'd say that the extra $1000 paid (2mo x $500 overpayment) during the legal proceedings, shouldn't be recovered at all. After all, its for the KIDS. Its not alimony. Simply pay $500 the next time and everytime therafter and deal with it.

As to the NCP being in debt... I think it would be wiser of the CP to ask for a couple extra hundred over the course of a year or so. Asking a debt-ridden person for that much cas at once only pushes them farther into debt. And if they go even farther into debt, the CP will only continue to have problems getting the CS.

But then, I've never been in or near a CS situation, so what do I know?
