I think the point is that they never specifically show him being killed. They show him being attacked by the Romans, and it's presumed that he dies, but they never show his body. Which fits with both the fictional and factual version of the tale. In the book it's stated that his body was never found, and what is known of the possible historical Spartacus is the same. His body was never found on the battlefild.
So it could be possible, of course, that he was captured by the Romans, or had some other sort of fate. Varinia clearly assumes him to be dead, (and the movie wants the viewer to draw the same conclusion) but it's never known for certain.
