Read the following and decide :((URBANA – A Homer woman accused of stealing thousands of dollars from a former employer is due back in court next month.
Loretta Esworthy, 58, appeared in Champaign County Circuit Court Thursday to be arraigned on two counts of felony theft. The charges allege that by deception, she obtained more than $300 from Barr Real Estate on June 7, 2004, and on Aug. 12, 2004.
Assistant State's Attorney Adam Dill said the criminal charges allege she took about $4,000 from the Champaign real estate company.
However, a civil lawsuit filed against Esworthy last summer by the insurance company for Barr alleges she stole in excess of $154,000 from the company.
The suit filed by Cincinnati Insurance Company said Esworthy worked for Barr between 2000 and 2004 and that her duties included handling receipts from tenants who rented apartments from Barr.
In January 2005, the suit said, it was discovered that she was not depositing cash payments made by tenants but was instead pocketing the money and misrepresenting the tenants' payments in company ledgers. The suit said she wrongfully kept $145,452 from cash receipts and that she also wrote herself checks from Barr checking accounts for her personal use in the amount of $8,959.
The suit said Esworthy met with Barr representatives and admitted her wrongdoing but never paid any of the money back. The insurance company paid Barr and is now suing Esworthy for the return of the $153,411 (the claim minus Barr's $1,000 deductible) plus another $8,310 that the insurance company had to spend to audit the Barr records to find how much was taken.
Esworthy is represented by Champaign attorney Art Lerner in both the criminal case and in her civil lawsuit.

Her criminal case is set next for April 10 before Judge Tom Difanis.))
