 No. Irish, Dutch and Belgian cable operators pay the BBC to clear the rights for retransmission of the signal that spills over. The Austrian cable operator that retransmits BBC1, 2 etc is doing so illegally because it hasn't paid the BBC anything.

When I had cable in north London, I had RTL, and RAI Uno, which were taken off free to air satellite. Obviously everything is dubbed in German or Italian, so rights were less of an issue. However, ORF Austria and SRG Switzerland DO encrypt because they only have rights for those countries, whereas German broadcasters usually buy rights for Germany, Austria and Switzerland, though ARD and ZDF
had trouble with the World Cup.

In Gibraltar and Spain, nobody cared when the BBC was encrypted as part of the Sky package and nobody cares now. The government minister I spoke to in Gibraltar was so out of touch he didn't know the difference between BBC1 and BBC Prime!
