I wonder how long before we see schools trade players. The contract forms would have to be revised, such as establishing right to assign the personal services. But if enough NIL is offered upfront, eventually someone could be willing to accept such a term.

sparman makes an excellent point. If I pay you to perform a recurring service, you are my employee. Once you cash my check, you now owe me the contracted service on terms and in the manner I decide.

Player A signs with Michigan for $1 million.

An enthusiastic booster at Florida decides that he really really wants Player A to be a Gator. What's to prevent the booster from calling up the Michigan collective and offering, "I'll pay Player A $5 million to transfer to Gainesville and, for your trouble, I'll pay the Michigan collective $2 million. That's a 100% return on your $1 million investment." Assume that Player A is thrilled with the prospect of wearing orange and blue.

This should be legal. These are voluntary transactions between consenting adults, all willing parties to separate business contracts.

The logical end point in the near future is that there will be consenting trades between college programs. But because there is no union or collective bargaining at this point, unlike in the NFL or NBA, there are no limitations or guard rails.

Right now, once the various collectives learn to play hard ball, it'll be anything goes.

Perhaps eventually there will be regulation imposed or a voluntary contract between a players union and the employing institutions. But until then, it's the wild wild west.

Perhaps the more likely offer is, "I'll pay Player A $1 million to transfer to Gainesville and, for your trouble, I'll pay the Michigan collective $5 million. That's a 400% return on your $1 million investment."
