Not sure where you got 3% from, but the info that the FWC put out when they were looking at changing the buck reg's a few years ago was 10% of hunter take more than two antlered deer. Following is a quote of what the FWC put out.

"Options S2 and S3 include a statewide limit of two antlered deer per hunter. During the 2000-2001 hunting season approximately 10% of deer hunters harvested more than two antlered deer, constituting about 23% of the antlered deer harvest. If a bag limit of two antlered
deer had been in place that year approximately 17,000 fewer bucks would have been harvested, the majority of which would had been available the next year as older, larger antlered deer. Option S3 includes an additional restriction in that one of the two antlered deer harvested would have to have three or more points on one antler. This would restrict harvest and protect more bucks, although an estimate of the number cannot be calculated.

Options S4 and S5 include a statewide limit of three antlered deer per hunter. During the 2000-2001 hunting season approximately 4% of deer hunters harvested more than three antlered deer, constituting about 12% of the antlered deer harvest. If a bag limit of three antlered deer had been in place that year approximately 9,000 fewer bucks would have been harvested. Option S5 includes the additional restriction of one of the three antlered deer having to have at least three antler points on one side. These options are less restrictive than S2 and
S3 and they would protect fewer bucks."
