NAIA RULES BERRY MUST FORFEIT 10 MEN’S BASKETBALL GAMES
Accidental Violation Causes Vikings To Forfeit First 10 Victories of 2003-04

Mount Berry, Ga....The National Association of Intercollegiate Athletics (NAIA) has announced that Berry College’s men’s basketball team must forfeit its first 10 victories of the 2003-04 season, due to an accidental violation of NAIA rules that was self-reported by the Berry athletics department in late December.

The violation occurred when the official academic transcript of Kirk Feinswog, an honor student, was misinterpreted by college officials upon his transfer to Berry. Because of this misinterpretation, Feinswog was believed to be eligible to compete when, it now appears, he was not. When the error was discovered, Feinswog was immediately taken off Berry's active roster.

Feinswog had attended Berry as a freshman and sophomore before transferring to Louisiana State during the 2002-03 academic year. It was upon his return to Berry this fall that the misinterpretation occurred. The NAIA ruled that the situation violated the NAIA's 24-hour rule, which requires the student to have earned a total of 24 hours during the previous two terms of college attendance. Feinswog decided to return to Berry during his second semester at LSU and dropped two classes that would not have counted toward his major at Berry.

Along with the forfeiture of the 10 games, the NAIA ruled that Feinswog, a junior, must be credited with a year of competition. Feinswog has regained his playing eligibility, but will be charged with his final year of eligibility if he plays again this season. He could come back next season and play the entire year. Berry is appealing the NAIA’s ruling that Feinswog be charged with a year of competition.

The NAIA made it clear that Berry has not been put on any kind of probation and remains eligible for post-season competition. The college has taken full responsibility for the violation.

Feinswog, a six-foot-four-inch guard who earned All-TranSouth honors in 2001-02, averaged 11.1 points, 4.2 rebounds and 2.1 assists per game in the 15 games in which he played this season. He scored a season high 28 points against Barber-Scotia on Dec. 17, the last game he played.

With the forfeiture of the 10 wins in which Feinswog played, Berry’s record is changed from 13-7 overall to 3-17 overall. Berry is 1-1 in TranSouth Athletic Conference play. Individual and team statistics will not change.
