Regine sues 2 in vehicle sale

Songbird cites warranty breach for ‘defective’ van

SINGER Regine Velasquez has filed a P203,773 damage suit against two
men who allegedly sold her a defective van which she claimed barely
made it to her garage after a test run in Baguio City.
Velasquez charged Severino Oliva and Derick Oliveros with breach of
warranty with damages in the Quezon City Hall of Justice.
In a civil complaint, the singer said she bought a 2003 model silver-
gold Ford E-150 van (plate number RBU 484) from Oliva, with car
dealer Oliveros serving as an intermediary, last year.
The two had assured her that the van was brand new and in perfect
condition. They even gave her a warranty for it, she said.
In August 2005, Velasquez said she gave a down payment of P1.4
million, after agreeing to buy the vehicle for P3.5 million under a
contract of sale she had signed with Oliva.
The papers for the vehicle were thus transferred to her name,
through a loan she had secured from the bank, she added.
Velasquez said she started using the van almost immediately. After
two weeks, she brought it to Baguio to test its running condition.
But on the way home, the vehicle could no longer run beyond 20
kph. “In fact, the van could hardly make it to my garage,” she
added. The singer said she immediately called up Oliveros who told
her to have the vehicle checked at Ford Pasong Tamo.
The checkup revealed that the vehicle’s overdrive function,
converter clutch, pressure control solenoid and shift solenoid were
faulty, among other defects, Velasquez added. The singer said she
asked Oliva to take back the van and return the down payment minus
P200,000, since the purchase price had been considerably reduced.
But Oliva rejected the offer, she stated.
In her complaint, Velasquez said Oliveros and Oliva had failed to
comply with the warranties and representations under the sale
contract. She asked to be paid P3,773 in actual damages, P100,000 in
moral damages, P50,000 in exemplary damages and P50,000 in
attorney’s fees.

I see Regine doing this action as a good thing. She'll
need the practice for when she takes on big-time suing
someday. But one of my uncles was questioning why she
would be doing it for that kind of amount considering
the number of times and steps it takes to get the whole
process of doing it and then staying with it. Not sure
if he read and understood the whole article when he
spoke his opinion but the songbird got my support
about it. It'll be a good experience that she'll
need to tackle detractors in the future. - mmJun
