If you lose at arbitration you cannot go to Civil Service. The same goes if you lose at Civil Service you cannot then ask for arbitration. After your step 3 hearing you will be asked to choose between Civil Service OR Arbitration.

Also, the e-board does have the right to move forward to arbitration or not. It will all depend on what the attorney feels are the chances of winning, and if the decision will effect others in the future.

There are many variables that go along with grievances, the more specific you can be the better this question can be answered.
