Subject: 3. Rules for Dancing Classes ***** 3.1 Transfer of Pupil Rules

3.1 Transfer of Pupil Rules

3.1.1 In these Rules "Registered Teacher" means a person currently registered with An Coimisiún as a teacher. "The appropriate authority" means the Regional Council or, in a region without a Council, the committee, sub-committee, association, person or persons delegated by An Coimisiún to administer the Transfer Rules in the region.

3.1.2 When a new pupil joins a registered teacher's class and he/she has been the pupil of another registered teacher within the previous year the Secretary of the dancing authority of the Region in which the pupil resides must be informed by the new teacher in writing.

3.1.3 Where there is no Regional Council the notification must be sent either to An Coimisiun itself or to the authority (see Rule3.1.1)appointed by An Coimisiún to deal with transfers in the region.

3.1.4 Where a pupil, formerly the pupil of a registered teacher, joins the class of another registered teacher, the new teacher must not enter that pupil in any registered comp etition until six months following the date on which notification of the pupil joining the
new class is received in writing by the Regional Council or other appropriate authority unless the pupil is allowed to compete by reason of Rules 3.1.5 or 3.1.6 below.

3.1.5 A pupil should not be withheld from competition where the change of teacher occurs because of: -
(a) Death of former teacher.
(b) Retirement of former teacher.
(c) Failure of former teacher to re-register with An Coimisiún.
(d) Significant change of place of normal residence of the pupil – travel, time, and expense should be given due
consideration.
(e) Closure of the teacher's class normally attended by the pupil and where that teacher has not another class within a reasonable distance of the pupil's home.
(f) Any other circumstance in which the Council or other appropriate authority considers it would be unfair or
contrary to natural justice to insist that the pupil be withheld from competition.

3.1.6 A pupil should not be withheld from competition on joining a new class where a period of at least one year has elapsed from the date on which the former teacher was informed of the intentions of the pupil ceasing to be a member of the class.

3.1.7 Where a Bun grad/Beginner dancer is one month or less in a class the Transfer rule (6 months) does not apply.

3.1.8 A transfer cannot be recognized unless a child attends the class of a new teacher. A private session with the individual pupil only will not constitute attending a class.

3.1.9 A pupil is not subject to the Transfer Rule (6 months) where there is a change of status within the class i.e. where a new or another teacher commences teaching under the name of that school, or where a teacher leaves a school. In this situation, the pupil will have ONE opportunity within a one-month period to decide on their choice of dancing school. His/her teacher will inform the pupil of this in writing and a copy of the letter will be sent to An Coimisiún or other relevant authority.

N.B.If a pupil leaves the class of one registered teacher, and goes to the class of another registered teacher, and later returns to the class of the original teacher, the Transfer Rule (6 months) applies, as this is considered to be two moves.

3.1.10 Where a pupil is asked to leave a dancing school by the teacher, for whatever reason, that dancer will serve the 6 months restyling period with a new registered teacher, unless Rule 3.1.6 applies (i.e. that the dancer is already out of dancing for one year).

3.1.11 Where a pupil leaves the class of a registered teacher, & joins the class of an Irish Dancing teacher not registered with An Coimisiún, and later returns to his/her former teacher, the Transfer Rule (6 months) does not apply. However, where a pupil leaves the class of a registered teacher, joins the class of an Irish Dancing teacher not registered with An Coimisiún, and subsequently joins the class of another teacher registered with An Coimisiún, that pupil must not be entered in any registered competition until six months have elapsed following the date of receipt of written notification by the Regional Council or other appropriate author
Where a pupil has been 12 months out of dancing i.e. has not attended any class and has not competed in any competition, then this Rule does not apply.

3.1.12 Where a pupil leaves the class of a registered teacher (CLRG), & joins the class of an Irish Dancing teacher(CLRG) in another region and later returns to his/her former teacher, the Transfer Rule (6 months) does not apply. However. where a pupil leaves the class of a registered teacher (CLRG),joins the class of an Irish Dancing teacher(CLRG)in another region and later returns to the original region but joins another teacher (not his/her former teacher) then the Transfer Rule (6 months) applies.

Where a pupil has been 12 months out of dancing i.e. has not attended any class and has not competed in any competition, then this Rule does not apply.
