The fact is, nothing has been passed to the Department of Energy yet, and the Secretary had recused himself from nothing. Perhaps, he was referring to Ashcroft? Holling also stated that Ashcroft's recusal was the same as those taking the Fifth Amendment. He was unable to explain that remark, which isn't surprising.
