Yes, this is definite discrimination. You should google the Americans with Disabilities Amendment Act of 2008 and download a copy. This amendment to to ADA law of 1990 was signed into law in Sept. of 2009 and clearly states they are not allowed to discriminate in the manner they are trying. I would be nice, but firm. It is quite possible they are not aware of the changes made to the ADA law, changes made specifically to protect those with learning disabilites such as Dyslexia. However, the law is on your side and if they are unwilling to shift their position you should pursue the matter. Even if this means hiring a lawyer. It means your son's future and he is entitled to accommodations that even the playing field, especially when it concerns high stakes testing.
