Subject: Don't Let Spay/Neuter Law be Used to Kill Adoptable Pets

On October 31st Governor Pataki signed into law a measure to help stop
the needless euthanasia of so many healthy, adoptable dogs and cats
simply because there are not enough homes for them. The spay/neuter law,
which took effect on November 1st, requires that shelters, pounds, humane
societies, SPCAs and rescue groups either spay/neuter dogs and cats
before adopting them out or do one of the following: 1) take a minimum
$35 deposit from adopters refundable upon proof that they have
spayed/neutered their pet; or 2) charge an adoption fee that includes the
cost of the spay/neuter procedure and then pay for the procedure when it
is performed. Deposits that are not refunded under option 1) are
forfeited and go into the Animal Population Control Fund - which means
that they come back to the jurisdiction where the money was collected in
the form of low-cost spay/neuter vouchers for other adopters of unaltered
animals.

Despite the express purpose of the law to save the lives of companion
animals, it seems that in some places in the state, pounds and shelters
are deciding to euthanize animals rather than do the minimal amount of
work associated with taking and refunding a $35 deposit.

Your help is needed to ensure that this does not happen in your town or
county. Your State Senator and Assembly Member voted to pass the
spay/neuter law because they believed that providing incentives to
spay/neuter would help stop pet overpopulation and the senseless killing
of adoptable pets. Please contact these representatives and ask them to
ensure that the law is used for its intended purpose in your town and
county, and that it is not used as an excuse to kill healthy cats and
dogs who deserve a chance to find a good home.
