Subject: Bellevue's Existing Ordinance

CITY OF BELLEVUE ORDINANCES AND POLICIES

DOGS, PETS AND ANIMALS:

(Chapter 6, Bellevue City Code)

1. All Humane operations of the City of Bellevue are handled by the Nebraska Humane Society, 8801 Fort St, Omaha NE 444-7800

2. All dogs and cats in Bellevue who are over 4 months old must have a license tag and collar at all times when off the premises of the owner. In the absence of a tag, a dog or cat shall be regarded as a stray whenever off its owner's property.

3. Only three household pets over 6 months of age are allowed in the City of Bellevue. (Ordinance #770, Zoning Code Book). This includes dogs and cats.

4. A dog or cat license is good from January 1 to December 31 of each year.

The cost of a license is:

a. For each spayed or neutered pet.......................................................................$ 2.00

b. For each unneutered or unspayed pet...............................................................$10.00

c. For spayed or neutered pets belonging to senior citizens (65 or older)............$ 0.00

d. For each animal not voluntarily licensed by its owner.....................................$20.00**

e. For a special breeding license to a person who harbors, keeps, or

maintains more than one pet for breeding purposes........................................$30.00

**Including, but not limited to any license issued due to animal impound, complaint, or officer check will be in this category.

You must show proof that the dog or cat has been neutered or spayed by a certificate from a licensed veterinarian and you must show proof from a licensed veterinarian that the dog or cat has had its rabies shot. $5.00 will be held in trust for an unspayed or unneutered dog or cat and refunded at any time during the six month period after the fee is paid by showing to Town and Country a certificate from a licensed veterinarian that the animal is permanently sterilized.

5. If a dog or cat does not have its rabies shots, the owner shall pay a $20.00 fee to the Nebraska Humane Society to be held in trust. This $20.00 fee shall be refunded at any time before the dog or cat reaches 1 year upon showing proof of a rabies vaccination to the Nebraska Humane Society. If the $20.00 fee is not reclaimed by the owner within 9 months after it was placed in trust with the Nebraska Humane Society, the fee shall become the property of the Nebraska Humane Society.

6. Duplicate licenses cost $.50.

7. Any pet shop or grooming shop must have a license, and the annual fee is $15.00. Obtain from Bellevue City Clerk, 293-3007.

8. A person who keeps more than one animal for breeding purposes must obtain a special breeding license from the Bellevue City Clerk at $30.00 per year. Phone: 293-3007

9. Regular licenses are available at the Nebraska Humane Society, 8801 Fort St, Omaha NE tele:444-7800.

10. All dogs and cats must be kept under restraint and must wear license tags.

11. Every female dog or cat in heat shall be confined in a building or secure enclosure in such a manner that such female dog cannot come into contact with another animal except for planned breeding.

12.Any vicious animal shall be confined by the owner within a building or secure enclosure and securely muzzled or caged whenever off the premises of its owner.

13. Any animal that poses an immediate threat to any person may be killed by any police or animal control officer if said animal is off the owner's premises, even if the animal is licensed and vaccinated for rabies.

14. Any unrestrained pet shall be taken by the police, animal control officers or humane officers and impounded in the animal shelter. There is a $5.00 per day kennel fee for each day the animal has been impounded, plus the following impoundment fee:

a. $30.00 for the first time any animal licensed to an owner is impounded in a 12 month period.

b. $60.00 for the second time any animal licensed to an owner is impounded in a 12 month period.

c. $100.00 for the third and subsequent times any animal licensed to an owner is impounded in a 12 month period.

15. All impounded dogs or cats shall be held for a period of not less than five (5) days. At the expiration of that time, the impounded dog or cat shall either be humanely destroyed or sold.

16. Stray animals that are roaming at large, remaining on private property without the consent of the owner or tenant, or remaining on or frequenting public property, are deemed to be the property of the City of Bellevue. If said stray animal cannot be captured by a conventional means, every police or animal control officer is authorized to use any means necessary to remove said animal.

17. No person shall keep or permit to be kept any wild animal as a pet.

18. The owner of every animal shall be responsible for the removal of any excreta deposited on public walks, recreation areas, or private property by his animal or deposited as a result of the owner's cleaning of an animal cage, pen, or other animal facility.

19. The owner of an animal shall be liable to the owner of any real or personal property whose property is damaged, altered or defaced by his animal.

20. The owner of any dog or cat shall be liable for any and all damages that may accrue to any person, other than a trespasser, by reason of having been chased, bitten, mauled or scratched by any such dog or cat.

21. Any person violating any provisions of this Ordinance shall be deemed guilty of a misdemeanor and either punished by a fine of not less than $50 nor more than $300 for each offense or shall be ordered by the court to turn the animal in for adoption or disposal.

22.No person shall own, keep or harbor any dog or cat within the city which by the constant barking, whining, howling, meowing or yowling in an excessive, continuous or untimely fashion, may be declared a public nuisance and impounded by the City of Bellevue.

23. Dog kennels are allowed only on property zoned agricultural.
