Council to hear testimony March 25

Pit bull owners will get their day before the City Council March 25 when councilmembers take public testimony on a proposed new ordinance that would place tough new controls on the controversial animals but would not ban them.

The city’s animal control ordinance is facing a proposed revision that specifically defines the pit bull terrier as a “vicious animal” subject to several new controls.

The animal is defined closely in the proposed new law as “any dog that is an American Pit Bull Terrier, American Staffordshire Terrier, or Staffordshire Bull Terrier.” It further says that any dog “that has the appearance and characteristics” of those breeds will be considered a pit bull.

The new ordinance would require pit bull owners to carry at least $100,000 of insurance coverage as a hedge against any injury or death the dogs might cause.

The ordinance also imposes a laundry list of mandates concerning restraining the dogs on property belonging to the owner, on property not belonging to the owner, and during transportation.

Pit bulls kept indoors must be given no way of exiting the home at will. Doors, windows and any other exit must be locked.

When outside on their owners’ property, the dogs must be kept at all times in a secure “barricade” that must be six feet high with an attached top.

When the dog is on property not in the possession of its owner it must be muzzled and restrained by a leash no longer then three feet. Alternatively, the dogs may be kept in locked cages or crates.

Pit bulls must also be caged or crated when being transported.

The ordinance is also clear that any pit bull posing an immediate threat to any person may be killed by a police officer or a humane officer.

The ordinance is an attempt to resolve concerns about the danger many feel pit bull terriers pose. A recent incident in Omaha, in which a pit bull tore away the genitals of a young boy, revived concerns about the breed.

Owners, however, have argued that the dog is no more prone to violent behavior than any other dog and that responsibility for such incidents lies with bad owners who raise the animals inappropriately.

Councilmember Theresa Hatcher has argued for an outright ban on the animal.

The evening of March 25 was set for a public hearing on the ordinance. The council will convene at 7 p.m. and will take testimony both for and against.
