 校歌旋律是否原創？那根本不重要。因為有很多的學校也是借用某些歌曲的旋律而填上歌詞成為校歌。除了學校之外，國歌也是這樣的。銘基書院的校歌跟德國國歌是一樣的旋律，然而那個旋律既不是銘基書院所創，也不是德國為國歌而作的，他們都是借用了其他人的創作。中華人民共和國的國歌，原本叫作義勇軍進行曲，在中華人民共和國成立之前的創作，是毛主席用其為國歌而已。至於是否盜版？

一、如果得到作者或出版人的受權使用，便不是！

二、如果版權持有人已過身五十年或以上，便不是！

三、在第一次正式出版的七十五年後，便不是！

三者中只要其中一條成立，那便不是盜版了。
