Haven't we all heard about the woman who sued mcdonalds for 100 mill because her coffee was too hot?

If Bill Gates goes and says something defametory against some dude and gets fined 5 million, who cares poo change. But how would your life be affected if you got fined 5 mill pugsley?

Circumstances are always a primary consideration when deciding a punishment.
