If Brady sued the NFL..it would be a breach of contract suit...which uses preponderance of the evidence.

In the A. Peterson case, first, it was the Minnesota judge who bends over backwards for the union.

Second, all the evidence was there for the NFL to examine and they went decided the punishment based on known facts. That didn't happen here since Brady was so uncooperative during and after the investigation.

Text messages from the equipment guys show that Brady knew and demanded the balls be deflated way back in October. Unless you believe that they were made up texts back dated to October.

This judge is looking at if the process for determining the suspension was fair. I don't see anything in it that is unfair. 4 games would be the MINIMUM for fairness...should have been 4-8 in my opinion.
