Sealed records stop probe of EMS delay

An apparent delayed response by emergency workers to one of the victims of a quadruple homicide can't be investigated while the records are closed.

Officials can't yet review paramedics' apparent delay in treating a quadruple homicide victim last month because a court order sealed records related to the criminal investigation, a Sedgwick County spokeswoman said.
Any review would be pending a lifting of the seal, the county said Thursday in a news release.

It would be up to the court to decide whether any findings could be made public, said Kristi Zukovich, the spokeswoman.

She said no one has been disciplined or fired over the response by Sedgwick County Emergency Medical Service. She said she is not aware of any changes to EMS procedures because of the case.

Early the morning of Dec. 15, police and paramedics found four people lying in a field near 29th Street North and Greenwich Road. They had been shot. Brothers Reginald and Jonathan Carr have been charged with the killings.

Later on the same day the bodies were found, EMS director Tom Pollan said he and his staff were investigating why more than 2 1/2 hours passed between the time paramedics reported four people dead and the discovery that one, a man, apparently was still alive.

At 2:59 a.m. that day, EMS workers reported the four victims were dead. But at 5:37 a.m., an EMS supervisor asked for an ambulance to take one of the victims to Wesley Medical Center. At 6:06 a.m., the ambulance arrived at the hospital. Ten minutes later, the man was pronounced dead.

Eleven days after the killings, on Dec. 26, District Judge Clark Owens issued an order closing records related to the criminal investigation. The order cited concern for not jeopardizing fair trials.

On Thursday, Pollan referred questions to Zukovich. She said she didn't know whether the EMS staff had reached any conclusions about the response.

In the news release, the county said the Medical Society of Sedgwick County could not review the EMS response because of the seal.

"We are in a unique situation where, while we would like to have the results of the review, we also understand the roles that this information plays in the case and don't want to jeopardize that," Zukovich said.

In the meantime, she said, "we want people to be assured that they will receive the best medical care."
