I think that's still pretty bad. Not so much what he is saying, but that he thinks he should. He is a SC justice, not a theologian or a particular expert on the ethical questions surrounding the death penalty. The fact that it goes against the teachings of Christ (which are, after all, a mainstay of the Catholic Church) might be a consideration. Maybe Scalia is one of those that believe in the parts they like.
