The problem here is, if Spike CAN change, how unfair has it been all this time for Buffy to stake vampires if they can be rehabilitated?

Making him a special case seems to take away from the specialness and uniqueness of Angel, as well. I don't know, it's interesting storytelling, but it just seems wrong in a way I don't think I'm relaying very well right now.

I'd feel especially cheated given what "Disharmony" showed us, that vampires, despite their wishes of the time, CANNOT change what they are.

But hey, that's me, and I have a thing for VampHarmony, so take it with a grain of salt.

As for souls, I always figured they offered a moral compass -- one can always opt to ignore it, but vampires just gravitated towards evil largely because they didn't even have that compass/conscience/whatever. I may know that something is wrong, and feel bad about it, but I can still DO it. Heck, Angel feels sorry for what he did in the past, Spike STILL doesn't -- that may well be part of what a soul entails. Spike might not kill again (although I'm not sure on that), but he's yet to show any remorse or acknowledgement that what he did before was WRONG.
