It's probably one of the following:

-Official tape, used

-Bootleg recording or rip from DVD

-Official Japanese DVD or LD (You can tell...it's a hellava lot more expensive)

-VCD set from Singapore or HK....some idiots actually think the censorship sticker they place on VCD sets here is a seal of authenticity.....it isn't. The green round sticker is just that, a censorship label....they use it bootlegs too.

I guess you'll just have to look at what the person is selling. If it's VCD it's probably a bootleg. If it's DVD it might be a bootleg or might be usedif the price is cheap. If it's a NEW anime that hasn't found a distributor in the US yet (eg, One Piece, Angelic layer etc) it's probably a copy.
