Only just stumbled across this thread, to be honest I've not really checked out the message board section before...

Anyways, with regard to your statement:

"An enclosed premise is any yard or section of land privately owned, fenced off for the pupose of keeping intruders or any unauthorised persons out of this section of land.Persons must be warned that this area is fenced off for such purpose and entry is not allowed unless specifically authorised. ie. KEEP OUT.

Being found on enclosed premise's for an unlawfull purpose is deemed by statute to be an offence and a constable may arrest without warrant."

It's the last paragraph which interests me. If someone was to be found within the grounds of the hospital having entered over the fence but doing nothing other than walking around the premises then surely it can't be claimed that they are on enclosed premises for an unlawful purpose, as they are simply on the enclosed premises without any real purpose!

As far as I understood it trespass comes into play, but as this is a civil offence the police cannot intervene.

In my experience of the matter I would be very surprised if anyone found by the police simply exploring a site such as the CRCMH ended up getting arrested. Of course this assumes you are polite and open about what you are doing when talking to the police officer who found you rather than giving it lots of attitude. Having a camera with you tends to add credibility to the fact you are there out of curiosity rather than criminal intent also ;-)
