We shouldn't have to have licenses, insurance shouldn't be mandatory. But I also think the state has an duty to protect us from people who have demonstrated a reckless disregard for life and property (i.e. drunk/stoned drivers) I don't think sueing them will do the trick--most don't even own a toothbrush.

When I was a student my car was totalled by a jerk (fortunately I wasn't in it). He wasn't drunk but it was obvious he was stoned out of his head. He had no insurance (he lied to the police about having insurance, so he was never even cited for it) and no job. So here I was a struggling student and I lost my car because of an irresponsible and there was no recourse. It still makes me mad when I think of it.

I'm not sure what the answer is. But there has to be a way to keep these kinds of people off the road and if they are on the road to protect the innocent or at the very least give them recourse.
