Let's go ahead and put a fine point on it.

The suit brought by governors is going nowhere. They're basing it on interstate commerce laws. I'd be willing to bet if it goes to the USSC it will be heard on an expedited basis. I don't see a constitutional law professor not crossing all the Ts and crossing the Is. Let's take it a few steps further.

Isn't it the goal to purchase insurance across state lines? Bingo. Interstate Commerce.

If they try to overturn it in the senate, they need 68 votes. Think they can garner 68 votes? I don't think so.

Let's look at some of the other similar laws that apply across state lines by looking at car purchases:

1. The minute you purchase, you're going to pay sales tax.
2. Then you have to buy license plates. Every state requires it. In Indiana, the cost is based on the age and type of the vehicle. BMV determines the cost. You have to renew every year and the cost gradually goes down as the vehicle ages. And if you finance, interest is not tax deductible for state or federal taxes.
3. Then there's a little matter of vehicle insurance. Is there any state that doesn't require it? In Indiana you either have insurance or you must show financial responsibility and most insurance has uninsured motorist so you're in essence, paying for those who don't have insurance.
4. Now you can drive the car PROVIDED YOU HAVE A DRIVER'S LICENSE. EVERY STATE REQUIRES IT. ANOTHER FEE.
5. Finally, you can drive that car but it's going to need as and you're going to pay tax on every gallon
of gas you buy. That tax goes to the highway tax funds which pays for maintaining roads, highways and bridges on which you drive. There's nothing requiring all of that tax wyou pay will be spent only in your state but across state lines.

Violate anyof the laws and see what it gets you.

With the inclusion of the student loan package, cutting out the middle man, increasing Pell grants, extending health insurace coverage to their offspring to age 26, reworking a repayment schedule, do you really think any parent (or student) in college isn't going to jump for that?

It also forbids insurance companies from denying insurance based on pre-existing conditions and prevents them from dropping insurance when people need it the most. It also removes lifetime limits.

The connection has already been made that the plan was based on Mitt Romney's insurance plan for MA. Scott Brown also voted for it as it now stands. There were 161 Republican ideas incorporated in the law.

Is the new law perfect? NO. There's virtually no one who got everything they wanted. The point is that it can be ammended as time goes on just as SS and Medicare and Medicaid were ammended. None of these programs were popular when enacted. How many congress people receive benefits from any of these three programs? How many of them have family members who are students?

At what point do we start reigning insurance company scams? They'll always find an excuse for denying insurance. That's where their profits come from. Granted, oversight has been lax but they've proved their intent. They'll now be forced to spend more on actually providing insurance rather than increasing their profits.

Finance will be the next measure up. Who's happy with banks and their whole finance industry? They've also proved themselves incapable or self governance. Let the chips fall where they may.
