To answer you question, to my knowledge, no punishment was implemented should the child fail to properly use the bathroom. Simply no reward was given. The child learned proper bathroom habits by remembering which behaviors were rewarded. The reason this is not seen as punishment is because the child is not in possession of the M&Ms, the parents are; therefore, you are not actually taking away a "goodie" from the child.
