Thank you for instructing us to carry out due diligence to comply with the asbestos management regulations 2004 effective May 2004.

The objective of the survey is to locate suspected asbestos containing materials, collect sufficient information on their presence, location and condition and to produce a report indicating affected areas identified and presumed. Since May 2004 this is a statutory requirement and the minimum information required to enable the person responsible for managing the building to formulate an ongoing asbestos management plan. An asbestos management plan also has to be considered when instructing construction companies on work. The report should be retained by the client advisors as prior to contemplating any building works it is likely a contractor would want to see the report to fulfil his duty. Surveys before demolition and refurbishment are required under CAWR and CDM regulations. Most surveys will be undertaken to enable asbestos to be managed in premises. In these cases, the aim of the survey is to locate the presence and the extent of any ASBESTOS CONTAINING MATERIAL and present the information in such a way, which allows the employer/duty holder to manage the risk.

There are 3 types of survey referred to in MDHS100 and the inspection will be undertaken by a person who has sat and passed the British Occupation and Hygiene Society Exams and is duly competent to assess the risk.

The type of Survey you have instructed us to do is a
* Type 1 (Presumptive survey

Reporting on asbestos is based on “Material Assessment and Algorithm” the survey will produce an assessment of the condition of the asbestos containing material/presumed asbestos containing material and the likelihood of it releasing fibres in the event of it being disturbed in some way. An algorithm is a numerical way of taking into account several influencing factors, giving each factor considered a score. These scores can then be totalled to give a material assessment score. The use of algorithms is not infallible, but the assessment process is clear for all to see, so if discrepancies arise, it should be possible to track back through the assessment process to find the root of the error. The algorithm will consider four key parameters:
Product type; Extent of damage; Surface treatment; Asbestos type

The report is essentially a risk assessment which will form the basis of the management plan, giving a guide on priority for management and identifying materials, which will most readily release airborne fibres if disturbed.

The report will consider the description, age and nature of the premises (for residential managed flats this will be confined to the internal and external common parts).

If you have initially instructed a Type 1 survey (which does not include sampling), where asbestos is suspected the Surveyor will recommend a Type 2 (MDHMS100) Survey be conducted and that samples be taken. Samples will need to be sent out to a laboratory for testing and the cost of sample testing is in the region of £30 per sample. We would not normally sample structures constructed after 2000 unless suspect materials are apparent. In instructing a Type 2 Survey it is implied that your permission to take samples is granted, this will cause some disturbance, although this will be kept as minimal as possible.

Asbestos Bulk Sample Analysis is conducted by using Polarised Light and Dispersion Staining Techniques. Dispersion Staining is used to describe the colour effects produced when a transparent colourless particle or fibre is immersed in a liquid having a refractive index near to that of the particle or fibre, and is viewed under a microscope using transmitted white light (based on HSE Publication MDHS 77).

The following caveats will be repeated in our report:

A Type 1 Survey is non-invasive whereas a Type 2 Survey is based upon a semi-destructive inspection of an unfamiliar site. During the course of the survey all reasonable efforts were made to identify the physical presence of materials containing asbestos within the areas of the building which are subject to future refurbishment works. It is known that asbestos materials are frequently concealed within the fabric of buildings or within sealed building voids so that it is not possible to regard the findings of any survey as being definitive. It must always remain a possibility that further asbestos containing materials may be found during refurbishment or demolition activities. For reasons that will be set out in the report, the results cannot give an assurance that all asbestos materials have been found and must not be thought to do so. The nature of the survey is to target key locations of accessible voids and areas. The report will therefore present evidence from the inspections and (where applicable) any the sampling and analysis undertaken.

No air monitoring will be carried out whilst the survey was undertaken and therefore care was taken not to cause disturbance or fibre or contamination of clean surfaces.

Equipment, machinery, ducting etc will not be moved, opened up or examined for the purpose of this investigation except in the odd occasion where hatches were available.

Any person undertaking work within the buildings should be told of the presence of asbestos. This briefing also applies to any other person associated with the site, including staff, sub-contractors and others.

All the recommendations that will be described in the report will be based upon assumptions made after consideration of the type of material, condition of the material, its location, analysis result and type of use the area is thought to be subjected to. However, statutory authorities or others, could require amendments based on local knowledge, change in legislation, change in use or indeed, other conditions of criteria.

The report will remain valid until alteration works have been carried out. Care should be taken by consulting COSHH assessments of products to be introduced to ensure no asbestos containing materials are introduced.

This report has been written with reference to the various Guidance Notes etc, issued, and current at the date of this report and describes circumstances at the site on the date the investigation took place.

If I am concerned and wish to take surveys and proceed to a Type 2 Survey where practicable, this will be confirmed with you whilst we are on site, so that the necessary arrangements can be made.

I confirm that our fees in connection with the preparation and type of work on survey are £350+VAT.

THE ASBESTOS MANAGEMENT SYSTEM

In the case of Type 1 & 2 surveys it is required that the duty holder puts a full management system in place, one for communication and one for periodic checks. Every time workmen or new employees are on site it is necessary to carry out a site induction with them and get them to sign the communication sheet to say that you have actually shown them the report and highlighted the area of concern to them.

If in the report it says to check the condition of a particular ASBESTOS CONTAINING MATERIAL (Asbestos Containing Material) every six months (e.g. a cement roof), then either yourself or someone delegated by yourself, checks the material, if the material is still in an acceptable condition, sign and date the inspection sheet to say that the material has been checked and the condition is still good. If the condition has deteriorated, a specialist must assess the next steps.


APPENDIX – SURVEY TYPES IN DETAIL
Type 1 survey
The Type 1 survey aims to locate the presence and extent of any suspect ASBESTOS CONTAINING MATERIAL and assess their condition. No samples are taken. Sampling and analysis is thus deferred. All areas should be accessed and inspected as far as reasonably practicable. Therefore a Type 1 survey can only PRESUME or STRONGLY PRESUME the presence of asbestos.
• Presume. You must presume asbestos is present in:
• Any rooms, areas or locations that you cannot or are unable to survey.
• Any material that is likely to contain asbestos. Using your knowledge of likely ASBESTOS CONTAINING MATERIAL will help you make a decision.
In both these circumstances you must presume asbestos is present unless you have evidence to the contrary, such as:
• Only known non-asbestos materials were specified or used.
• Construction date was post-1985 (for amphibole ASBESTOS CONTAINING MATERIAL).
• Construction date was post-1999 (for chrysotile ASBESTOS CONTAINING MATERIAL)
Remember such evidence can be unreliable, for example:
• Materials specified were not used.
• Poor asbestos removal work left asbestos containing debris and residues in an area thought to be asbestos free.
• Strongly Presume. You must strongly presume asbestos is present in:
• Products where fibres of the appearance of asbestos are clearly visible.
• Where laboratory analysis has confirmed the presence of asbestos in a material of similar appearance and use.
Any materials presumed or strongly presumed to contain asbestos must be assessed. (Material Assessments are covered in detail later in this course).

Type 2 survey
In a Type 2 survey ‘representative’ samples of suspect material are taken. A Type 2 survey can be:
• Stand-alone (completed as a one off exercise).
• Completed following a Type 1 survey (e.g. the Type 1 survey locates the presence and extent of any suspect ASBESTOS CONTAINING MATERIAL followed by the Type 2 which confirms the presence of asbestos).
• Completed in conjunction with or preceding a Type 1 survey (e.g. To reduce the number of samples taken evidence from a Type 2 survey is used to identify homogenous areas that can be recorded as Strongly Presumed to contain asbestos).
A Type 2 survey would not normally involve destructive inspection (e.g. Removing panels to gain access to an infill). Although does involve undertaking a material assessment. The number of samples required, so as to be considered representative is covered under Sampling Strategies later in this topic.

Type 3 survey
A Type 3 survey is used to identify and locate all ASBESTOS CONTAINING MATERIAL in a building due for major refurbishment or demolition. A type 3 survey may involve destructive inspection (e.g. Removing panels to gain access to an infill). As this type of survey is used, as the basis for removing asbestos prior to refurbishment or demolition a material assessment is not required except to note areas of damage or debris. Estimates of volume and surface area of ASBESTOS CONTAINING MATERIAL should be made.
