No. The necessity is tested by what the cops know--not by what the innocent bystander knows, and the way you phrase it the cops really are doing it because the reasonably fear for their safety. The objective truth of the matter makes no difference. I'm curious how it is you think the rule could be otherwise.

You didn't see it on TV when a drunken Scot tourist knocked on some Houstonian's back door, got blown away, and the grand jury refused to indict.

What does either incident have to do with your question?
