A lawsuit should be seen as a last resort, but you need to start setting up the stage for a successful one. You have all sent letters to BMW I assume. In a letter to BMW, consider saying something like,"In a court of law, a negligence ruling requires that the defendant 'knew, or reasonably should have known' about the potential risks associated with a particular tort. The contents of this letter and enclosed previous letters should sufficiently constitute such knowledge"
