Subject: Need feedback to help me with Lemon!

1) I would like to get an idea as to the number and percentage of us with defective engines that were misled into believing that they were getting a "NEW" engine only to receive a remanufactured engine.

2)My new engine has a problem. In 2nd, 3rd and higher gears the engines is not smooth during brisk (half-throttle, not floored)acceleration between 5500-8000rpm. It almost acts like fuel pressure is failing. BMW is trying to say that this is not a problem and normal. Does/Did anyone else's new or old engine do this?

In my state an auto can be lemoned for ANY of the following:

1) A defect that affects safety (my engine blew at high speed and cover the car in oil, including the tires and brakes) I am luck to be alive! BMW has not been able to state that the new engine does not have the same defect.

2) A defect that affect drivability. That is why I want to know if others peoples engine has the symptoms that mine does (not very smooth between 5500-8000rpm). BMW is trying to say there is nothing wrong with my car.

3) Three repair attempts for the same problem. I have already brought my car in for 3 repair attempts of the rough running between 5500-8000rpm (at half-throttle). Again, they are saying that because the computer is not recording a fault that nothing is wrong with the car. That is why I am trying to find out if other cars have the same symptoms. Fortunately for me and unfortunately for my friends, I have 2 friends that have just gotten new M3s.

4) Time in the shop. The manufacture has to give the consumer a new car or a refund if the car spends 30 calender days (including weekends) at the dealership for repair in the first 2 years (even if my car is running perfectly and there is nothing wrong with the car anymore!) My car has spent at least 23 days in the shop in the first 10 months.

The reason that I am trying to find out whether others were misled is because arbitrators hate it when manufactures do not act with good faith. If I can show that I was misled, by showing that others were also misled that should be enough to show bad faith. Civil ligation unlike criminal does not require proof beyond a reasonable doubt. All I have to do is prove it most likely occured. That is why
I ask if others were misled!
