You're right, from the perspective of hindsight. When I made that post, there was no such clarification of what the clause stated until Heywood responded to my post (i.e., with what you quoted). Then I found the other greatly damaging element that has not yet been clarified: right to change TOS at will.

Hindsight changes a lot, doesn't it?
