My guess would be someone who got GAFFed was the one to report the board. Duffman used to let some things sort of slip under the radar, as long as it wasn't illegal (things like warez or outright porn were definitely not tolerated at all). As far as I can remember, he appreciated a good sarcastic bit of humor. Unfortunately, he also has to cover his butt when someone does bring up a definite violation of the TOS.

Please note I haven't spoken with Duffman or any of the other support staff for a long while, so this is all just speculation on my part.
