Subject: Vietnam Vets that didn't put in claim untill 2006 -11

I searved in Nam from Feb/66 to Apr/67. In May 1981 I had a MI, in 1984 had a 4/Bypass,and 2 more bypasses since then, also a defib/pase-maker. In July 1987 went on SS Disability. I didn't file a claim because I didn't know I could. On Oct 16, 2006, I filed for Diabetis Type II, CHD, and a few others, also IUTD. I Disagreed with the award date. (The retro compensation was great but I could have made a lot more pay if I was able to work till retirement).

In Dec 16, 2010 was awarded 100% Disability, retroactive only back to Oct 2006. I sent in a NOD and am in the process of doing the paperwork.

My question is: How many VietNam Vets out their, didn't even know to file when they came down with on of the diseases that the VA had on the list? (Untill now since it came out in the open with the 3 new disease which were put on the list). If it wasn't for my brother-in-law, I wouldn't have known anything about submitting a claim for CHD (IHS) and Diabetes II.

The VA is stating that if you didn't file then, you can only get compensation retroactive to the date you filed. They (VA) use the "Nehmer v. USAVA as their reasning. I feel I am being penalize because I didn't file back in July 1987, or even in 1981 for the MI

If their are any Viet Nam Vets with or had the same problem, please send me a E-mail rogeroa@roadrunner.com. The more Vet's we have the better chance we have of getting better results. I just want what is due me after all I have gone through (Heart problems and lost wages).
