....that never stopped me from having an opinion before. I think that the "overpayment" (although I'm not sure why it's an overpayment if the judge hadn't made the ruling yet) should be refunded gradually, so as to not create a hardship for the child.

If there is a similar debt TO the child, I think it's better to do it gradually as well, so as to not provide a hardship to the NCP. If he/she truly doesn't have the money to pay in a lump sum, and he's expected to come up with the money all at once, it could be worse in the long term for the child. He might sell a car, for instance, to get the money, making it harder for him to get to work. Or he might take out a high-interest loan, making it hard to make the child support payments in the future. Or he might just (depending on whether or not he's scum) hit the road and not be able to be found. It makes more sense, IMO, to be moderate about it, and allow him to add a little to each monthly payment until the debt is repaid.
