Can he get some kind of temporary custody authorization? Something via social services or a court outside of the reservation? This is such a sticky issue because I know that the tribal courts try to keep native kids within their system. We deal with that a lot here too.

If the children are going into or have gone into foster care, social services is pretty much always going to prefer that they go to another family member. So I dont get why the father was not contacted when the foster care thing came about initially.

Me personally? I'd take the kids for visitation and turn it into an *extended* visit. Try to get at least a temporary custody order after the fact. One good thing is once he is off the reservation, I think the likelihood of tribal police chasing him down is fairly slim (I dont know that for sure however!). Also, if the mother and her boyfriend are such losers, how hard would she really fight to get them back?

He needs legal counsel, no ifs ands or buts about it.
