Subject: what would you do?

Two years ago my brother in law called to wish his daughter a happy birthday and she said daddy I am giong to a foster home tomorrow. He was in Missouri and they were in Michagan and he was unable to do anything at the time. His ex wife was going into rehab for drinking and the children had been abused repeatedly by her family.

He moved to Missouri to join the army and was accused of abandoning them. He got out of the armyand moved back to Michigan a year and a half ago after they had been abused in the foster home where the were placed.He has been trying to get custody of them since.But they were placed back with their mother.

Here's the catch. His children are native american on their mother's side and they were living on a reservation and on a reservation they have their own courts and police so it has been tied up in a tribal court. As a white man he has met with what he feels is extreme predjudice. Also the tribe gets federal money for everyone on the reservation wich gives them more cause to keep them in the tribe.

The children's social workers are on his side but at the most recent custody hearing the judge denied him custody and would not give him a reason.

Just recently he was awarded visitation and during the last visit he was bringing them back (6 hous away) when his daughter told him that her mother's boyfrien who is not supposed to be around the kids and as a stipulation of his probation (I don't know why he is on probation)is not supposed to be drinking, got drunk and fondled her. They pulled off at the nearest state police post and reported it and he was told to bring the kids home with him. But since it happened on tribal land it will stay on tribal land and they will be the ones to prosecute.

Then he found out how his ex and her new beau have been passing their drug tests. His children had been spying on him and accusing him of smoking pot. When my hubby talked to her and found out that not only does her mom smoke in frojnt of them she told the kids to try to catch their dad doing it so he would get into trouble. Plus she has been having them pee in cups so they and their friends could pass their drug tests.

My hubby also sat them down and told them the truth about their mother and father and told them I don't like your mom. She has hurt you and hurt cory and even punched my mom in the face and caused a seizure for no reason. But I do love you. You are not your mother and we have cried so manytimes wondering how we could save you from what was happening to you up there. We are trying to help you and keep you safe. Don't try to hurt us or start trouble with us.

They have heard so many lies from their mother and their dad has tried not to say anythingbad about their mom but my hubby laid it on the line for them.

When is enough enough?When the tribal system has failed them repeatedly? Before her confession he was considering just keeping them at his next visitation. Would you do the same? Would you have told them the truth about their mother or would you have played the maryter? BTW they are 7&9.
