The 1994 assault weapon ban defined an assault weapon
as follows:

Semi-automatic rifles able to accept detachable magazines and two or more of the following:


*Folding stock
*pistol grip
*Bayonet mount
*Flash suppressor, or threaded barrel designed to acommodate one
*Grenade launcher (more precisely, a muzzle device which enables the launching or firing of rifle grenades)


Semi-automatic pistols with detachable magazines and two or more of the following:

*Magazine that attaches outside the pistol grip
*Threaded barrel to attach barrel extender, flash suppressor, handgrip, or silencer
*Barrel shroud that can be used as a hand-hold
*Unloaded weight of 50 oz (1.4 kg) or more


A semi-automatic version of an automatic firearm

Semi-automatic shotguns with two or more of the following:

*Folding or telescoping stock
*Pistol grip
*Fixed capacity of more than 5 rounds
*Detachable magazine

I think any new ban will probably retain the above definition and probably place a restriction on the cyclic
rate of fire a semi-auto fireman can have. This is a result
of trigger assist devices coming on the market that allow
a legal unmodified semi-auto firearm to fire continuously
like a machine gun. Although the BATF has ruled that any
weapon with an external trigger assist device is an illegal
machine gun, the devices are easy to make and are probably
impossible to keep off the market. So if the cyclic rate
of fire is reduced to something like one round every two
seconds, the use of trigger assist devices like the Hellstorm 2000 or spring loaded stocks like the
Atkins Accelerator (already banned) would be largely
academic.
Attorney general Holder says the no-fly gun ban
will be put into place and believes it will hold
up to constitutional scrutiny in the courts. Since 1968
gun ban also precludes persons deemed mentally unstable
and those with dishonourable discharges from the military
and these people were often never convicted of any crime,
it would stand to reason that another class of unconvicted could also be added to the ban.
