The International Court of Justice settles disputes between nation states and does not have criminal jurisdiction.

Assuming you really mean the International Criminal Court, you'd have no jurisdiction because the US and Iraq have not signed on to the Rome Statute. Iraq did, and then decided it was not such a good idea. Some would suggest the transitional government had their arms twisted but nevermind. Seems there's a lot of that going around these days.

You might have to wait a while because they set up shop in 2002 and have yet to try anyone.
