They weren't able to find him. Buffy told Giles they tried to contact him after Joyce died, but that he had gone to Spain with his secretary.

Besides, it wouldn't have made much sense to put Hank in charge of Dawn. She wasn't his real daughter anyway.

Giles had been reinstated as a member of the Watcher's Council by then. He couldn't have used their sources to find Hank in Spain? If Dawn wasn't Hank's daughter then she wasn't Buffy's sister. As far as Buffy was concerned, Dawn was a part of her. Which should have left Hank as the only one with the legal right to serve as Dawn's guardian.
