MIDLOTHIAN - Controversy has erupted over high school senior t-shirts and the word "Hell" on the back of them, which resulted in a principal banning them and threatening a student with alternative school if she did not comply with his request for a list of students who had already bought the offensive shirts, students said.

Students at Midlothian High School, located south of Dallas, said the actions by school administrators were unfair.

The front of the t-shirts, according to students, has "Let's get the heck out of Dodge," with the backside having "And by Dodge, I mean Midlothian, and by Heck, I mean Hell."

A principal, according to MHS senior Matt Ostroski, asked a student selling the t-shirts for a list of names of students who bought them.

Ostroski said it was unfair and unconstitutional.

"Later that day [Nov. 5], a principal approached [a student] and asked her to provide a list of the students who ordered the shirt so they could be suspended," he said.

The student did not comply, Ostroski said.

When that happened, Ostroski said the principal threatened to kick her off of Honor Society and place her in alternative school.

School officials were on holiday break this week, and could not be reached for comment.

Ostroski, who posted his account on a message board, said about 72 of the estimated 360 seniors at MHS purchased t-shirts.

"The teachers who noticed a person wearing the shirt would either ask them to either change shirts or wear the shirt inside-out," Ostroski said. "Covering the word 'Hell' was not permitted, because they don't have anything against the word, they just don't like the shirt.

"It is interesting to note that since the shirt was banned, every student wants one."

Student rights groups have said such measures have been reversed in court, or through some other settlement, but outside legal experts are still deciding what action - if any - they should take.

"My legal contacts have been notified of this situation, but from the outset it looks like the same old thing," said Midlothian High School graduate Joey Dauben, who was approached by some students for help in the matter. "When will school officials and public officials get the message that our U.S. Constiutional rights are non-negotiable?"

Dauben has come under controversy recently for his Midlothian school board campaigns, as well as articles he's written on the district, most recently the football player-coach situation where a math teacher alleges star players harassed her.

"If we don't get our community educated in the Constitution, or what it means to have individual freedom, we will lose every right we were blessed with," Dauben said, noting he has put an online petition regarding the matter up for people to sign. "Simply banning a t-shirt because it is offensive is illegal, and as a public institution using taxpayer funds, the Midlothian school district should be aware of Constitutional and individual rights."
