Well, the recipient rights final report came out yesterday. I knew it was coming, because the risk manager at the hospital called my home, my cell phone, and finally called me at work wanting my reaction. I told her that I hadn't received it yet....I was at work until 2:30, and I would get the mail when I got home. She wants me to call her to set up a time to "talk". I don't think so........

Well the letter admitted all liability for what happened to me in the hospital. They admitted they didn't have enough staff on the floor at the time of the assault. They admitted that they didn't educate the patients about the call buttons not working, they admitted that the camera and mirror system didn't adequately show the far ends of the hallways.....so they wouldn't have seen him come into my room (or since they didn't have anyone watching the cameras anyway). They have already removed the panic buttons, installed new cameras and addressed the staffing issue. They are going to staff the floor according to the number and acuity of the patients on the floor. They also mentioned that they are going to contact outside agencies (Community mental health) about sending patients that are violent to the ward. Now the hospital wants to "talk"? Did you know that that rapist had to be put in restraints/isolation 4 times in 72 hours. They noted on the report that that broke the isolation/restraint procedure and a "team management group" should have addressed this issue. They admitted they didn't keep people safe.

I called my attorney, and his secretary told me to stall talking to the hospital until I see Bob tomorrow. Tomorrow we decide what to do. Mike wants to appeal to the state (which is my right), but I don't meet the criteria for an appeal. I got what I was looking for, and the hospital opened itself up big time for a lawsuit.

I called my insurance company and told them what happened to me. Carol got a copy of the letter, and since the hospital proved a lack of care, it doesn't meet the criteria for my insurance company to pay. They are going to get their money back, and I told them I will help them in any way they need.

I am in hardball mode........I am going to get whatever I can out of them. I just hope my attorney is ready for this. He has been very quiet throughout the process. He did tell me to not make an appointment until I get that letter. I have documented everything that happened.

I'm waiting for my doctor to cancel my appointment on Monday. Once he gets the report...it's all over. The lawsuit won't be filed by monday, so I may be able to see him to get 3 months of meds to get me by til I find a new doctor. I won't tell him that I have already got an appointment with a doc from UM........I just need the meds until that appointment. It will be interesting to see where his priorities lie.....is he gonna stand up for his patient, or is he going to bail on me and Sarah because of the hospital. I am certainly going to let him know that Ihave proof in writing about the liability.

I am a whistle blower......I have contacted every agency I can to report the abuse. There is a federal law protecting whistleblowers. If my doctor cancels, then I have proof of retaliation for standing up for my health and safety. Another branch of the lawsuit.

I called Geoffrey Feigers attorney, and he was a total asshole. He wants all my documentation sent to him first, he will "read it when I have time" and "if I am interested in the case I will call you". Fuck him....he was rude and nasty on the phone. My only thought is if I need an asshole attorney, he may be my guy. I'd rather stick with someone I know and trust, and know he isn't going to take all my money.....he will be fair.

Well, that is up with me.......taking 6 mgs of xanax a day to keep calm. My attorneys office called and received the letter, and Bob was looking forward to seeing me.

So when this is all over.......and I hit lotto hopefully, I want to invite you all to Michigan for the party of a lifetime. No one should be raped while trapped in a psych ward, and I am gonna make sure that they never, ever, forget my name.

Thanks for listening, sorry it's so long, but I am just reeling in my mind on what to do. For a few minutes I thought about not suing, since I got what I wanted. Then the risk manager kept calling me, and I thought, "I got them by the balls". Time to move forward and go get my money.
