I think it comes down to the law of the land at the time, meaning whether the baron was capable of having people killed without repercussion, and if so, whether this was typical behavior of his. The baroness likely would not have cheated on him if she expected him to kill her for it, even though she didn't think he would get home before sunrise anyway. Then again, the fear of getting killed didn't stop her from trying to re-enter the castle.

And technically the baroness committed two transgressions: she cheated on the baron, and she violated the terms of her exile. Had she done neither, she would be alive. But I still say her death is on the baron's hands, because the punishment was excessive for what she did.
