The following is a brief response to your issues:

1. I was involved in researching and proposing changes to the zoning by-laws you referenced. As part of the Utility Environmental Committee (UEC) we were charged with reviewing all ascepts of an impact of a "power plant" on the community. Based on our review we found out that the zoning by-laws prior to the 6/99 change allowed the siting of a "power plant" in ANY zone including residential. The UEC thought it prudent that this needed changing to ensure that power plants only be sited in industrial zoned land. This was identified prior to any proposals from Nickel Hill. The change was done to tighten up the zoning by-laws, not "allow" anything.

2. Sounds like an intrepretation problem. I have not reviewed the situation, but knowing the area where Nickel Hill is proposed to be located I believe the are is zoned I-1 or I-2 which is heavy to light industry. These zones could have anything from a power plant to a chenmical manufacturing facility, to any number of other "industrial" sources.

3. From my recollection there will be 2 "exhausts"/stacks from the turbines/HRSG sets (1 exhaust/stack per unit). The term "smoke stack" is an old world term that was used when the Merrimack Valley was the birthplace of the industrial revolution. These "smokestacks" vented coal-fired boilers that were very inefficient and created large amounts of "smoke". Nickel Hill is proposed to be a modern, efficient power plant that has exahusts for there units. I am not deluted enough to try to convince you that the exahust from the Nickel Hill units are perfectly "clean". But, in the great scheme of things these exhaust are orders of magnitude "cleaner" (on a pound of pollutant per Btu level) than most industries and even smaller commercial and residential combustion sources.

4. No comment.

5. I think this is a matter of defining property lines and from exactly where we are talking about. The Brox site is very large and the western edges of this property are within 1 mile of Campbell school. Based on the photos provided from the town permitting process, the exhausts from Nickel Hill would not be visible from the Campbell School. As far as impacts on Campbell school, the analysis conducted included worst-case modeling of all emissions from Nickel Hill which showed no adverse impacts compared to MaDEP and EPA standards and guidelines. If future statements are made that say the Nickel Hill will have adverse impacts PLEASE PROVIDE THE BACKUP TO THIS STATEMENT WITH EITHER ACTUAL MEASUREMENTS OR MODELING THAT SHOWS THIS TO BE TRUE!!!
