Yes - its time for the Grinder Pump issue to be brought up.
I ask each of you....
Would you want to pay for sewerage $240.00 per year plus
the cost of installing and maintaining and replacement of the grinder pump ($1400.00 to buy the next one) and to pay electricty fee to run the grinder pump which goes on every time you use the toilet, wash clothes, dishwater, sink water, showers-baths. These grinder pumps are only guaranteed for 2yrs if installed on the outside of your home. 5 yrs if put indoors.
We are article 6 at the town meeting scheduled for Oct. 22 please come and vote with us. The Meeting is scheduled but because of the budget not ready they may move it to November.I will keep you posted.
We are asking for installation and maintenance of pumps.
Why installation....across the way through the Forest is Dexter Ave and Windsor - the town has spend the money to have an easement so that these homes can be connected gravity fed to sewer. This resulting in them not having the grinders. Peters Pond from what Mr. Buxton stated on the Round Table months ago is going to run pipe through the pond so that they can be connected to gravity feed.
The Selectmen do not like the Word "Discriminate" but that is exactly what is being down to Forest Park Rd. and Raven Rd. and any home in Dracut that was told by the Sewer dept to get a grinder pump.

I am just curious about the rising prices in the cafeteria at Dracut High School. I am just curious as to why a case of 35 waters cost mearly 5 dollars but yet the cafe. chagres a dollar for them ? In addition to the prices being outrageously high what about the kids that cant afford these unnessecary high prices? I am truly saddened by the fact that a student has to paay such out rageous prices for food that shouldnt as much as it does anywhere. A baked potatoe = one dollar. A dollar for a signle potatoe. Thanks to the thousands of people that lined the Dracut Tercentennial "Old Home Days" parade route and attended the two days of activities. It was great to see such an outpouring of support for this historic celebration. Special thanks to all the Dracut Tercentennial Committee members and volunteers,the Dracut Firefighters and families,the Dracut School Department and PTO's,the Dracut Police Department,Public Works,the Town Manager and Town employees,plus all the Civic Groups and their sub-committee support staffs. The monumental dedication of all these groups made this Tercentennial event the great success that it was.

. . . but please fly them correctly!
If you are flying the flag the "long" way, hanging from the side of a building or other structure, remember that the Union (field of stars) hangs to the the observer's left and the flag's right.
I certainly commend all the residents of Dracut and elsewhere that are proudly displaying our flag, but it pains me when I see the flag hung incorrectly, with the Union on the wrong side.

I think it goes with out saying that this is the worst thing thats ever happened to the U.S. Being from the Mtv
generation (i'm 27) i never had a need to be patriotic!
we have never seen anything like this!! I'm filled with rage
and disbelief. The only thing to do right now is help those who are hurt, aid the families of the dead and pray for the lost.
I ask myself what can I do? Im not a medic or can i afford any great contributions? So I think the best thing for me to do would be to use my business to raise money for the effort in New York and for our local families in grief.
I own a production company (sound & lighting) you might have seen us at the Dracut Concerts. What I propose
is to put together a benifit concert to raise money. My services would be free of charge and I know i could get free entertainment from my roster of clients.
If there is anyone who knows how to set up a fund
or venues willing to donate a place to hold this i will take care of the rest.

That is how we feel when school starts and our kids have to go back to the Jr High and back to the torment of verbile abuse that the kids are slinning around.I am part of a group of parents that have been talking about how we will deal this year,our kids are not perfect and we know kids can bring on trouble but this is not the case. There are a few students that are being alowd to threaten and verbily bully our kids and the only thing that is ever done is they get a talking to by there guidence councelers.We comned them for there efforts but it is not working. School is just about to start and the threats are starting warrning are being sent out before our kids even get threw the door. WE have tried to talk with the parents of these children and nothing is helped ( the apple does not fall fare from the tree). What we need is more parents to get on the school to handel this with more disapline and conseqences the only time the children get into trouble is if it comes to phisical violense . Now this is a good thing however why does it have to come to that if it is stoped at the sorse it will not get to that point. Also this zero toerance policy may sound good but there are children being beaten and getting suspended or dentention for being a victom. We had a child try and walk away from a fight and ended up with 2 broken ribs and OH YA ! Suspened for fighting. So lets tell our kids don't defend your self or you will get suspened get beatin instead.......the fact remands we have childern that have Headaces, stomace aces , dieria and some throwing up because they can't take it . Some kids say they rather get hit then have to deal every day with the fear and embaresment of what so called COOL KIDS OR TOUGH KIDS are putting them threw. What will happen this year and what will it take for the school to start wakeing up and help our kids with this problem? Oh a talking to or speach from our priciple , We need more and our Teachers hear and see this and do nothing. We had a student stay in a class room afaird to go in to the hall and told this teacher why and the teacher gave them detention and sent the student into the hall and before the student got to the next class was punched in the stomace. Dracut may not have gunns and knives to worry about but the MOUTH can do damge that stays with a child for the rest of there lives! So Dracut stop bragging that we are so awsome with better MCAST and better schools and more teachers look in to the closets and see the skelitins that are tormenting our children. Are you a parent that thinks everything is fine and your child is not having trouble guess what you could be wrong or it could be your kid this year . We are not going to take this laying down this year we will be taking this as far as we can even if we have to expose the sweet little town on national TV to get help. Our kids deserve the wright to walk the halls with out fear!

Unlike some, I was able to watch in total horror as the events of the past week on the television behind me as I worked. Like all, I cried at the loss of life as the towers crashed down, a places I had visited so many times as a young child, never realizing just how beautiful those buildings were. A fear came over me, knowing my children were in school and I was here without them, not knowing what would occur next in this land that I love so very much.
I now am watching John's memorial service at St. Francis in my own private way of attending with the family and friends, somehow letting them know my heart and love is with them.
I grew up off of Marsh Hill Rd. I know John's house and land very well. I remember watching as that area was developed, and thanked John for saving so much of what was in my heart as a Dracut resident. Because of John and his love for our land, my childhood and early adulthood still stands. It is a place I still drive to when life has taken its toll on my nerves and I need to find comfort and peace.
I mourn today, not just as a Dracut citizen forever thankful for all this man has done for us here, but as an American citizen for all that lost their lives in this uncomprehendable act of terrorism.
I have lit over 30 candles per evening, both in my yard and in my house since this has happened, and will continue to do so until all victims are found and our America rises back up out of the ashes, into a stronger nation showing those responsible for this horror that they inflicted upon us can not break the spirit of a nation so strong and free.
Lastly, I would like you all to know that our Police Dept. has not left John's families side during all of this. I can't say enough thank you's to these men that I know, and how proud I am to know them and have worked by them. Next time your ride by our fire stations or police dept., don't look at them as buildings, but as people that would gladly give their lives, in order to save yours.
God Bless America and Thank you, John for all you have done. Please kiss my son up there in heaven, and keep a watchful eye over him until I am able to hold him in my arms once again.

it is time for all civilized people to appreciate US contributions
to the world. It is over a century now that America has opened it's
gates and received people from other countries: People in need of
work, education, and a chance to live in the promise land of freedom.
It is over a century that America has been aiding other nations who
were in need of almost anything we can imagine. America has extended
it's hands many times generously, helping nations financially, supporting
righteous causes and even if it meant sacrificing it's sons. As most intelligent
people understand it is not easy to play the big mother of the world,
sometimes things will go wrong, certain actions will be interpreted differently
and some may not be just. America is controlled by human beings just
like other nations and humans make mistakes. However its contributions
to this world justify it's actions, I believe this is the greatest nation in
history and we should all be proud or if not, at least understand of that
which it stands for! I have never before expressed such opinions because
I am puzzled by those that refuse to see beyond certain actions taken by
the US, furthermore I would like to avoid animosities.
Today America mourns those that were lost on account of these recent
terrorist attacks!

So much has been broken in the last few days. Our hearts, our peace of mind, our nation’s security and our notions of security. It was the first thing that struck me. One minute all is right in the world, an hour later, it was hard to imagine if the world would ever be right again.
It seems we live a charmed existence on this part of the globe. It is usually our lot to be spectators to the world’s disasters and tragedies. We don’t have earthquakes or large scale flooding. No mudslides or wild fires, no rampant or large scale violence. Even our cities, while enduring many of the blights most urban areas engender, seem to be safer, harbor less strife and crime as others.
On Tuesday, that random blessing of bucolic geography was also broken. The airport I was at just two weeks ago was the starting point of it all. A man who lives two miles away was taken from us and the plane he piloted was made to crash into a skyscraper. I pass his farm everyday on my way to work. A lady I work with was crying Friday because her son is in the army. I didn’t know what to say to her. I have no experience with anxious mothers who are afraid their sons may die in a war. My only experience with war has been in a theater or in my living room watching The Deer Hunter or Saving Private Ryan.
Like everyone else, I have often struggled with why God would permit such suffering. I hear the stories of messages left by those who knew their lives were now measured in minutes instead of years and I can’t help by wonder about that merciful God who I was taught loved us. Our Priests and Pastors will tell us that we have to rely on faith and faith, by its very nature, holds as ransom our understanding and comprehension.
I watch the thousands of people who have volunteered to help locate survivors in the piles of concrete and twisted metal. I am in awe of the courage those fireman and police officers displayed doing the most unnatural thing imaginable. Running into the buildings that were on fire and doing so without a moments hesitation. Their only goal was to help those people trapped inside. I believe that as they ran up those stairs and the building came down, that their assent was only paused briefly before their souls completed the journey to be with a proud God in heaven. And, I have to conclude, that if there’s any purpose to the suffering of so many people it is that it avails ordinary men and women the opportunity to be Godlike.
In our suffering we are now united and we’ve come to acknowledge that America is indeed a place to appreciate, love and honor. Friday night my wife went down to the driveway with her candle. Of course, I have too much swagger and irreverence to do something so sentimental. I was watching the news and saw people jumping out of windows and I heard a message a Dad left for his wife and kids on their answering machine. He was scared but brave and told them all how much he loved them.
With a lump in my throat I brought a candle downstairs and stood with my wife.
God bless America. Our deepest sympathies to all of the lost and especially to the Ogonowski family.

I read so much about the Jr. High, Nickle Hill, Grinder pumps, but nothing - nothing can be so bad as what happened today in our lives. The plane that was hijacked and crashed into the World Trade center-
My heart goes out to the families of the passengers that were on the American Airlines flight and to all the others that died or injured at the World Trade Center and Pentagon.
I am so devastated. ----
I just watched on tv the World Trade center tower fall. Why - Why do things like this have to happen. I am so upset - all these innocent people dying - I pray that God will give us the strenth to help us through this.

John "Ogie" Ogonowski was my classmate, fraternity brother and friend during our years together at Lowell Tech. We were both in engineering...but John's love was flying...he was in the Air Force ROTC Program. After graduating in 1972, we went our separate ways...John into the Air Force...I went into commercial nuclear power. We kept in touch ...I remember attending his wedding to Margaret in Long Island...but as the years went by became separated by life..family and work taking us in different directions. I knew after his time in the service he flew for American and I often wondered if I'd run into him in my travels. But the dastardly and cowardly events of 9/11 have taken that opportunity away forever.
I'm sorry John that I didn't make the extra effort to keep in touch more... I remember that smile and the antics we shared ..Pi Lambda Phi, the Civic Club and others. I remember your family...your Mom and Dad especially...and how they treated me like one of their own.
It is with heartfelt sympathy that my wife Mary and I extend our condolences to John's wife Margaret and children, brother Jim, parents Alex & Terry and all the Ogonowski's. Though years have passed, I have lost a good friend...We will all miss him.

I would like to commend the residents of Dracut for their heartfelt efforts to make today a day of honor and rememberance. As I was making my way to visit with my mom in Saugus, MA I had the chance to take the back road through other towns such as Reading, Wakefield, and Lynnfield. I must say Dracut stood out in their patriotism. With Flags flying hi, and candles readied for vigil this pm. It was a sobering drive home this evening through Saugus Center with a group of 25 to 30 people gathered, flags in hand and candles lit. Equally enlightening were the makeshift vigils along Rt. 113 as I entered Dracut at 10:00pm (Friday) evening. I was in a state of panic that my candle may not be lit yet. A frantic call home to my husband, revealed he, himself lit a candle to be displayed in memory of all those lost to this horrific act. My house adorned by flags and the candle lit welcomed me home. How fortunate I was that my family were all safe at home. How sad I was for those who are suffering so greatly at this very same time. My heart has truly broken.

My heart breaks today for the loss of those innocent lives and for their families and for everyone suffering from today's events. The bombings of the WTC, the Pentagon and State Department, the plane crashes - it's all tragic.
Let us hope and pray for peace, damn these cowards that have chosen to destroy human life through terrorist acts, they will have to answer for their crimes someday.

I have sat and watched. I have sat and listened. For several days I have held in my emotions. It was not willing, but was blocked by shock. Feelings of anger and sadness held inside me. This morning they have been released. I turned on the television to see a televised story of countries overseas having a 3-minute moment of silence. The changing of the guard’s format was even changed in Americas honor. Their countries people crying with us. I myself am crying as I write. I now see and feel the unity of America and it’s people, along with other countries showing support.
I feel better after finally releasing my emotions, but the sadness will always be in my heart, for it has been broken. I have support in my family and friends. They have support in me. “I love you” are the words I speak. True feelings to my wife before we rest for the night. True feelings to my wife before we separate from each other when going out and doing daily chores. True feelings to my family after speaking with one another.
The cowardly acts that played out on September 11th were terrible. With the bad, will come the good. The good has been shown in the unity of all Americans. Our country fathers have our support, and we have theirs.
From bother and sister to neighbor and friend, we shall stand united. American flags are flying on cars and at homes and businesses. Wave to your neighbor as you pass. Lend a helping hand, even when not asked. We shall overcome this tragic event and become one.
We stand, one nation under God.

What wonderful sentiments are being expressed out here on the forum, especially in regards to the loss of John Ogonowski. This tradgic event, and the loss of so many innocent people has truly broken my heart. Personally, at 36 years old I have only had one redefining moment in my life as a young girl. With a heavy heart, I must now say that I have two. I was wasn't born to experience any of the world wars, and was just a toddler at the the end of Vietnam. My experience with events such as these were limited. Outside of the Gulf War and the Oklahoma City Bombing, I haven't had any experiences yet that would compare to those this Nation may be involved with next. This is no peace keeping mission, nor are we going to the rescue of others. We as a Nation are now fighting for all the we hold true to ourselve, our "freedom". I have found my range of emotions totally unpredictable. From profound sadness, to anger, to hopeleness. I will keep vigil for all those lost to this tradegy and fly the American Flag proundly at my home. It will remain their indefinitely as I support our nation and show my pride in the United States of America. It will symbolize my sadness for all those who have lost their lives to this tradegy as well as all those in the past that have fought to keep our freedom alive. And it will remind me of how precious life is, and how abrubtly it can be taken away. As with all tradegy, I hope there will arise something positive. And in this case, it has made me acutely aware of what it mean to be patriotic. It has made me think beyond my own life to those around me. It has opened my heart and mind to the potential we have as a United Nation.

What a heartbreaking time for the Ogonowski family! I wish to offer my very deepest sympathy to them all. He will be sadly missed by all who had the pleasure of knowing him. He lived across the street from my parents and he stopped by often, either bringing over blueberries,corn,and other good vegetables from his farm, or sometimes he just brought a friendly hello, a warm smile, and words of concern. He got along great with my dad, who used to help him out with farm machinery before his beautiful house and equipment barn were finished. We all thought the world of John and this is such a shocking, terrible loss to his family, friends, and the town of Dracut. The memorial outside his house is unbelievable-the flag hoisted on the crane will take your breath away. Rest in peace, dear John, and God bless your lovely family.

Am I missing something? I haven't seen the doors of the Christ Church United of Dracut open all week. I am disappointed. I thought that all local churches would open the doors (arms) and welcome all that wished to pray and mourn the tragedy of this nation.

I wrote this poem for my mother as she struggled with surgery for Lung Cancer. It was intented to give her hope. To understand she was not alone in her pain. Can you feel it? If you drive up and down Lakeview Ave., you'll see what I mean. I realized today that when I lowered my flag yesterday that I wasn't the only one. The streets are bordered by American flags, telephone pole after telephone pole. As well as homeowner flags adorned on houses and poles (also at half-mast).
The outpouring of respect and sympathy is simply remarkable. I don't think I can ever remember a time when I was more proud of the community that I belonged to. I am honored to be a resident of Dracut. I think it was Ben Franklin who said at the time of the Declaration of Independence, We must all hang together, or most assuredly, we will all hang seperately. That spirit definitely lives on today. God Bless.

Today I wake on the morning after the day that will be black marked in American history forever. I am still in shock and saddened of what transpired in front of our very own eyes. As myself, and millions of people watched an act of terrorism play out live on national television. Innocent lives were taken and America as we know it has been bruised forever.
My prayers go out to all the families that have loved ones that have fallen, missing, and injured. To all that are involved in the search and rescue, many thanks come your way. You are angels that have been sent to help in this difficult time.
We as a nation are very angry. We ask how something like this could happen in our very own backyard. That answer may never be answered, but will always be a reminder that it could happen at anytime and anywhere. We should not blame ourselves, but search for answers to resolve it. America needs to come together to give each other support, now and in the future.
To the entire family of John Ogonowski, my prayers are with you.

one of the blackest days in

Hijacked airplanes rammed the

Why in the world were our kids sent home from school today?
No other towns in the area that I know of did this, even Boston.
Hundreds, if not thousands, of kids were sent home to TV reports of attacks on our country.. with those of us at work thinking they were safe at school.
They needed a calm, normal feeling environment. I didnt find out til hours later that they had been sent home.

Today is the big day for the power plant issue in court. For the sake of the Dracut residents, I hope a victory is scored against the power plant. I feel that a power plant is not needed in Dracut, and from the majority of negative comments on both forums, I believe the majority agrees. Time has passed, and things have changed in Dracut since 1998.
I do recall a deadline for the permit being in place for August. August has come and gone, and it has been stated that there has been no contact from the potential buyers.
I, as a resident and voter of Dracut would like to see this issue given back to the people and not the Selectmen. Pull back the decision and let the people vote if they do or do not want this plant in their back yard. Denying the people of Dracut this opportunity will simply state that the town fathers know the majority will vote no on the power plant.

Boy how times changes with each passing year. Today I came home from work, and as usually I looked at my children’s papers that they brought home from school. This school stamped papers just made me realize that the world isn’t getting better, and that our school children are more at risk for criminal activities.
I am referring to the CORE background check, which in my opine is a very good thing to have in place. However I wonder how many parents feels the same way. Another one of the paper that was brought home was ATTENDANCE SHEET, which states that the school has the right to file a complaint with the state, for failure to attend school. A child can only have 7 unexcused absent during a session, and or 14 half days of unexcused time.
It just makes me sit back and think, did I see all these paper and form last year when my child went to school. The answer is no.
My only hope and pray are that our schools here in Dracut and all around the United States, have a safe and sound school year.

The presence of officers has been beefed up. They show up when everyone is at work and leave before they come home.
Exactly the wrong times.
You see, this way, they can say that there isn't a problem there and can park on the side of a main road facing each other shooting the breeze. Then they can turn around and tell you that it's a manpower issue or that they get called to an emergency so they don't have time to enforce speed limits.
Michael is funny. I almost think he must be a cop because although he was not present at the meeting he touched on everything the police had suggested almost verbatim.
You see Mike you didn't have to go to the meeting. You already know what they are going to say. You just saved yourself some time to go talk to your neighbors.
The bottom line is the officers once again left it in the hands of the residents to "figure" something out. Is that what is required of Dracut residents? Vigilante justice?
Is it truly my responsibility to go personally talk with my neighbors in a 3 mile radius and ask them not to speed? Come on and get back to reality. Do I have to go tell the people in arrears of their taxes to pay their bill? Should I remind folks when trash day is? Knock knock. Who is it? Hidey Ho neighbor! The leaves are falling off the trees, just wanted to remind you it's time to rake.
Give me a break and slow down. Otherwise I hope you get caught and have to pay. Or better yet get a sermon from your neighbor.

Opponents seek repeal of permit for power plant

BOSTON -- In an attempt to render the Energy Facilities Siting Board's ruling on Nickel Hill Energy moot, opponents of the proposed power plant asked the Supreme Judicial Court yesterday to disregard the permit.
At an appeal hearing of the siting board's ruling yesterday, Robert Muldoon, representing the town of Andover, and S. James Boumil, representing Merrimack Valley Residents for the Environment, argued that the siting board ruled on findings they failed to make.
"With respect to the conclusion, there was a failure to make findings under the statute," Muldoon told the panel of seven judges.
The siting board operates under a statutory mandate to issue permits to companies that present the least environmental impact to the region. Muldoon contended that the board could not have determined Nickel Hill will minimize environmental impact at the East Dracut site while keeping costs down, because it barred inquiry into the price of alternate sites.
Muldoon also argued that the board's permit should be vacated because "there is no applicant for the benefit of the permit."
Although the proposed natural-gas plant was called off by its parent company, Constellation Power, in May, a new energy company is evaluating the 25-acre site and has extended its review until Oct. 1. The siting board permit can be sold to another company for the next 2 1/2 years before it expires.
Nickel Hill's lawyer David Rosenzweig said the anonymous company is seriously looking at Nickel Hill and has the wherewithal to go forward with the 750-megawatt plant.
"There are many players in the energy market, and although Constellation may have pulled away, there is still an interest out there by many companies," said Rosenzweig after the hearing.
But depending on the SJC's outcome, an interested buyer may need to go before the siting board again.
Boumil, said the board didn't look at the latest nitrogen-oxide control technology called SCONOX because it was too expensive.
William Reynolds, assistant attorney general, countered that the Energy Facilities Siting Board followed statutory guidelines and found another type of technology better.
The judges will now deliberate on the hearing and could take several months before a verdict is reached.

I sit here reading the article about the meeting on the speeding situation in the August 10th edition of the Lowell Sun. It is good to see that the police department took the time to meet with the Marsh Hill neighborhood and hear their concerns. After reading this article, I find that the Marsh Hill neighborhood was not to please by the outcome of the meeting. They should be pleased. They were shown the respect, and some information was swapped. They were handed a task and a follow up meeting will take place once it’s completed. Yet, the officers that met with this group were thought of as possibly pacifying the situation. Excuse me, but a quick fix is not going to correct the issue. And note, Marsh Hill Rd. and Old Marsh Hill Rd. are not the only streets being shown on the Dracut map.
Dracut is a spread out town that has little connecting roads to main routes that not only townies use, but out of townies use as shortcuts to and from work or wherever they may be going. Speeding on these roads are a problem for Dracut. The Police Department can only do so much to have coverage on these roads during the high traffic times. Any given situation can and will pull them away from these areas, so that they may provide service not only to specified areas, but also to the town in whole.
One thing the Marsh Hill neighborhood can do is talk to their neighborhood drivers. Officer Curtis supplied information to the group stating that a majority of the citations written in the Marsh Hill area were for residents of that area. Start off by addressing that problem with the neighbors.
Completing the request that the Chief requested of the Marsh Hill area residents, and then having that follow up meeting to discuss the findings is another step that can and should be taken.
The town may want to consider one-way traffic in the high traveling times. Make the problem areas one-ways in the opposite travel direction from 7 AM thru 9 AM, and 4 PM thru 6 PM. Hudson, NH uses this method as a way to cut the flow of traffic and speeders in their problem areas. I have a friend that lives in one of these areas, and he swears that it had a major impact on speeding and traffic in residential areas.
The Police Department may want to implement a radar trap on each of its shifts in the problem areas (if they already haven’t). 30 minutes of radar can go a long way, and also establish a presence that speeders will notice.
I have notice an increase in arrests that are listed in the Lowell Sun for Dracut. Is it because crime is going up? No. If you look at the reasons of arrests, they are mainly for motor vehicle violations, even DUI’s. Added patrol officers have enabled the department to be a little more aggressive on the streets. They in my eyes are doing a great job and are a credit to Dracut. Now, I don’t think that is pacifying.

At the last selectmen's meeting Jack DiTillio mentioned how the business across the street from the High School needs to be cleaned up. I believe that this business owner has been called on the carpet for this previously and made great strides in cleaning things up.
I just don't think we should keep badgering this guy without a set of criteria that can be applied fairly to all businesses: case in point; "The Dance Palace". If ever a business needed some cleaning this would be it.

Appeal of Dracut power plant set for Thursday

DRACUT -- The proposed power plant in East Dracut is still on hold, but the fate of its crucial state license is up for debate Thursday.
The town of Andover and a citizens group called Merrimack Valley Residents for the Environment are seeking to discard the Energy Facilities Siting Board's Nov. 13 decision to approve the Nickel Hill LLC plant through a joint appeal filed with the Supreme Judicial Court of Suffolk County in December.
Although the proposed 750-megawatt plant was called off by its owners, Constellation Power, in May, a new company is said to be reviewing the 25-acre site. But depending on the SJC's outcome, an interested buyer may need to secure another permit from the siting board.
The plaintiffs contend that the EFSB's Nov. 9 hearing was too rushed, unfounded and biased in favor of Nickel Hill.
In the 26-page appeal, plaintiffs raise 15 points objecting to the board's acceptance of certain environmental assertions about the plant at the hearing. Those assertions were not tested, the plaintiffs maintain, nor were witnesses for Nickel Hill allowed to be cross-examined.
"The bottom line is, this can't be allowed to move forward," said Laura Jordan, spokesman for Merrimack Valley Residents for the Environment. "We were not allowed due process, and there is too much misinformation and lack of information out there."
The seven-member state board couldn't have determined that the 750-megawatt plant will minimize environmental impact at the East Dracut site while keeping costs down, the appeal states, because it barred inquiry into the costs of an alternative site.
The appeal also questions the noise level at the plant. The project should require a noise-policy waiver from the state Department of Environmental Protection because it will exceed DEP noise guidelines, the appeal states.
At the hearing, each side will have 15 minutes to present arguments. On behalf of the siting board, Assistant Attorney General William Reynolds and Nickel Hill lawyer David Rosenzweig will speak. The town of Andover's lawyer, Robert Muldoon, and MVRE's attorney, John Boumil, will represent the plaintiffs.
After the arguments, the judges will deliberate. It could take several months before a verdict is reached.
The town is confident the appeal will not be upheld.
"I don't think the appeal will raise any particularly difficult questions," said Dracut Town Counsel Raymond Miyares. "It would astonish me that the court thought it would be a good idea to reverse the decision and turn on the agency with expertise."
MVRE's Jordan is eager for the appeal to go forward. The watchdog group, along with the town of Andover, have spent upwards of $250,000 and countless hours fighting the case.
If the court rules in favor of the plaintiffs, Nickel Hill will go back to the siting board for a supplemental hearing to address the issues in the appeal.
While an undisclosed company entered an agreement with Constellation Power to review the site with a deadline that was set for the end of August, a company has not come forward. Miyares, Dracut's town counsel thinks Constellation Power's preparation and presence at the upcoming appeal proves they are going full steam ahead.
"I thought at one point we would hear by the end of the month," he said. "As long as Nickel Hill is continuing to prepare, it shows they are moving with a commitment to go forward."
But despite the power plant's commitment, the plaintiffs are holding their ground.
"We feel we were denied due process by the siting board and feel we have a very strong case there," said Sheryl Poole, also of MVRE. "We feel it's imperative that the decision is reviewed by a legal authority and be remanded for further consideration."
If a new company decides to pursue the project, it would purchase the state and federal permits already obtained by Constellation Power for its Nickel Hill Energies subsidiary. Then it would begin the process of obtaining local approval.

When is the 1st day of school for Dracut and where can I get information about bus routes? This is more important this year (where the upper elementary grades are going to the Englesby School -- is the elementary schools keeping their same schedules?) I was surprised to find no information about this topic on this web site. No information in the Merrimack Journal or the Lowell Sun (we only get the Sunday edition).
Does anyone know if they plan to post this information at some time. I assume school starts on September 5th. Perhaps I'm being too impatient :->

As a cancer survivor I would like to thank my neighbor and Rep.Colleen Garry for her support on mandating insurance providers to insure research trials for cancer patients.Rep.Garry is not afraid to vote with compassion and care two qualities sometimes lacking in public officials.Since I'm in the thanking mood if I was to single out one individual for praise I would be here for hours.So let me say to all you people from the bottom of my heart my family and I want to thank you for your kindness,compassion.caring and hard work in the fight against cancer.I've made my battle with cancer a public event to help other survivors and their families.I Do Not tie this issue with any other my only motivation in going public in local newspapers etc. is to give hope and comfort to other people going thru this painful experience.I grew up in Greater Lowell and went to other countries and communities while in the armed service, upon my discharge from active duty I settled back here in Dracut where I live and worked.I feel so lucky to be from such as wonderful community!God Bless and thank you ALL!!

I heard that the Rotary Club is sponsoring a dinner for the Children's Memorial. Does anybody know anything about it? Where is it going to be built? Are there going to be names engraved on it?
