Because the Board is supposed to enforce Deed Restrictions and do not.. They CLARIFY the deed restrictions. It is up to the individual lot owner to decide if they want to take a chance and be sued. However, there is a two year statute of limitations. HOWEVER - if you want to SUE the board for Breach of Fiduciary and Breach of Contract... Go forward.... Eventually the subdivision will get back to enforcing the Deed Restrictions but not as long as you have board members who are violating the restrictions.... Your Choice....
